Agua Caliente Casino Rancho Mirage, Agua Caliente Casino Palm Springs & Agua Caliente Casino Cathedral City (referred to as ACCRM, ACCPS & ACCCC respectively in the promotion rules), otherwise known as the Agua Caliente Casinos, will host the “$1,000,000 Crack the Code Cash Giveaway” during the month of September 2024. ACE Club members shall have the opportunity to earn electronic drawing entries by playing with their ACE Club Card at their favorite slot machines or table games for the chance to win participation into the ‘Crack the Code’ game experience, where they can win up to a $1,000,000 Cash Grand Prize. ACE Club members shall be notified of this promotion via direct marketing offers, e-blast, and property collateral.

HERE’S HOW IT WORKS:  

On Fridays, September 6 -27, 2024 from 2:00PM-7:00PM, ACE Club members shall have the opportunity to earn electronic drawing entries to win a chance to participate in the ‘Crack the Code’ game experience for the chance to win up to $1,000,000 in Cash Grand Prizes. ACE Club members may earn electronic drawing entries to participate for the chance to win while playing at their favorite slot machines with their ACE Club Card properly inserted or by actively playing at a live table game with an open rating on the Casino Floor, at any Agua Caliente Casino and AC Fuel (Slots only). 

Electronic Drawing Entry Earning Slot Machine:

·      Electronic drawing entry earning begins on Sunday, September 1, 2024 at 12:01AM and ends ten (10) minutes prior to the last drawing on Friday, September 27, 2024.

·      Entries earned will be cumulative for the promotional period and will not expire until Friday, September 27, 2024, after the last drawing is complete.

o    (See “The Following Rules Apply to Promotional Drawings using PlayerSoft”, Rule #3 (a) (b) & #4).

·      Every 10 slot points earned = 1 electronic drawing entry into all drawings for the promotion.

·      Every $10 dollars played on slot machines equals three (3) slot points. Every $20 dollars played on video poker machines equals three (3) slot points. Rated table games play and live poker table play do not qualify for slot points. Slot points must be earned through slots or video poker only.

·      Electronic drawing entries can be earned based on slot play while playing with their ACE Club Card properly inserted at any of the Agua Caliente Casino properties, including Agua Caliente Fuel.

Electronic Drawings Entry Earning Table Games:

·      $5 table games theoretical win = 1 entry  

·      Electronic drawing entry earning begins on Sunday, September 1, 2024 at 12:01AM and ends ten (10) minutes prior to the last drawing on Friday, September 27, 2024.

·      Entries earned will be cumulative for the promotional period and will not expire until Friday, September 27, 2024 after the last drawing is complete.

·      Electronic table game drawing entries can be earned based on carded table games play at Agua Caliente Casino properties (excluding AC Fuel).

·      To activate their earned entries, the ACE Club member must begin a session of play at a table game a minimum of two (2) hours before the drawing.

·      Open table games ratings will be closed by a Table Games Floor Supervisor (or above) starting thirty (30) minutes prior to the first drawing and every two (2) hours until the end of the drawings to activate entries into the drawing.

·      If a player is actively playing at the time of activation, Table Games Floor Supervisor (or above) will close the rating to activate entries and then re-open their rating immediately. This process must be repeated for each activation time, to repopulate any new entries earned into the electronic drawing drum since the last activation.

Weekly Drawing Day Structure:

·      On Fridays, September 6-27, 2024 from 2:00PM-7:00PM, one (1) winner will be selected every fifteen (15) minutes to participate in the ‘Crack the Code’ game experience for the chance to win up to $1,000,000 in Cash Grand Prize (please refer to Drawing Schedule listed below).

·      ACE Club members will win the chance to participate in the ‘Crack the Code’ game experience one (1) time per promotional week at the Casino of their choice. 

·      The Cash Grand Prize may only be won one (1) time during the promotional period between all three (3) Agua Caliente Casino properties.

‘Crack the Code’ Game Experience:

·      After verifying eligibility, each winner selected will have the opportunity to participate in the ‘Crack the Code’ game experience. 

·      During each game experience, the selected winner shall then play the electronic “Odds On” game kiosk from the designated promotional area of each Agua Caliente Casino.

·      The “Odds On” game kiosk will have ten (10) Levels of game play, ascending from the lowest prize amount of $250 Cash to the Grand Prize of $1,000,000 Cash.

o   There will be differing icons that will be utilized for the levels. They are as follows:

o   Each Level shall have three (3) “Safe” icons to choose from.

·      Beginning at the lowest level (Level 1), the selected winner will choose one of the “Safe” icons. 

·      The icon shall reveal either a “Money Bag” icon, indicating a win, or an “X” icon, indicating a loss.  

o   If the selected winner chooses the “X” icon, they shall receive the prize at the last successful level.  

o   If the selected winner chooses a “Money Bag” icon, they shall continue to play the next level.

·      If the “Money Bag” icon is chosen, the selected winner shall then repeat the previous steps until they get an “X” icon. 

§  If the selected winner chooses the “X” icon, they shall receive the prize at the last successful level.  

·      If the selected winner successfully reaches the highest level on the “Odds On” game kiosk (Level 10), they shall win the Grand Prize of $1,000,000 Cash.

o   The minimum Cash Prize that could be won: $250 Cash (or $150 FSP/NNC). 

o   The maximum Cash Prize that could be won: $1,000,000 Cash Grand Prize.

·      In the event the Cash Grand Prize has been won and claimed, the next maximum Cash Prize that could be won is $5,000 Cash (or $3,000 in FSP/NNC)

§  In the event more than one (1) Grand Prize were to hit within the same time frame, the first prize to hit would be awarded the $1,000,000 Cash Grand Prize. 

o   The Cash Grand Prize may only be won once during the promotional period between all three (3) Casino properties.

·      Selected winners may choose to be awarded in Free Slot Play (also referred to as FSP) or Non-Negotiable Chips (also referred to as NNC) at 60% of the Cash value of their prize (see below). 

o   The Grand Prize Winner who must take the $1,000,000 in Cash (no exceptions). 

·      Winner must be present in order to claim prize.

$1,000,000 Cash Grand Prize Exception:

·      If the $1,000,000 Cash Grand Prize is won, the “Odds On” game kiosk on which the prize was achieved, will lock until the winner can be verified by vendor, ‘Odds On Promotions’. 

o   Any subsequent drawing winners at the winning property will then play a ‘Manual Game Experience’ until the ‘Odds On Promotion’ completes their verification process of the Cash Grand Prize and unlocks the game kiosk (See Manual Game Experience Rules). 

·      Each property’s “Odd On” game kiosk operates independently of the other properties. 

o   If the $1,000,000 Cash Grand Prize is claimed prior to the conclusion of the promotional period, any players who appear to hit the “Money Bag” at Level 10 Cash Grand Prize qualifier shall receive the next highest award possible of $5,000 Cash Prize as a consolation of the $1,000,000 Cash Grand Prize.

§  Free Slot Play may be chosen in lieu of the Cash Prize at 60% of the cash value except the Grand Prize of $1,000,000, which must be taken in Cash.

·      The $1,000,000 Cash Grand Prize may only be won one (1) time during the promotional period between all three (3) Agua Caliente Casino properties.

Manual Game Experience Rules:

·      In the event that the $1,000,000 Cash Grand Prize is achieved, an announcement will be made that the “Odds On” game kiosk is temporarily locked in for verification, any subsequent winners for that winning property’s promotional day will play a ‘Manual Game Experience’ to determine their prize until the game kiosk is unlocked.

·      Each winner participating via the ‘Manual Game Experience’ shall be presented with up to twenty-one (21) envelopes, each containing a Prize Card with one (1) of the remaining prize options. There will be the following quantities of each Prize Card available:

o   The remaining envelopes shall then be shuffled and used again for any remaining drawing winners that occur on that promotional day.

·      Once the $1,000,000 Cash Grand Prize has been verified, the vendor shall return the game kiosk to ‘Normal Game Mode’. The ‘Manual Game Experience’ will conclude and all game experience play will return to the “Odds On” game kiosk.

·      Prize Pool per Property: 

o   Total prize per property per week – $31,500 Cash (or $18,900 FSP/NNC); 

o   Total prize all properties per week – $94,500 Cash (or $56,700 FSP/NNC);

o   Total prize promotion combined all three (3) properties (4 weeks): $378,000 Cash (or $226,800 FSP/NNC) 

The Following Rules Apply to Promotional Drawings using PlayerSoft: 

1.     Slot players must earn electronic drawing entries by accumulating slot points. Players can accumulate slot points while playing slot machines anywhere on the Casino Floor with their ACE Club Card properly inserted into a slot machine, at Agua Caliente Casinos and AC Fuel. Slot players earn one (1) electronic drawing entry per 10 slot points earned during the promotional period. Electronic drawing entries are automatically entered into the PlayerSoft “virtual” drawing barrel.

2.     All qualifying slot and/or table games points for the $1,000,000 Crack the Code Cash Giveaway must be earned starting at 12:01AM on Sunday, September 1, 2024 and will end after the last drawing is completed on Friday, September 27, 2024. Slot points can be earned at any Agua Caliente Casino including AC Fuel. (See “Electronic Drawing Entry Earning Slot Machines”). Table Games points can be earned at any Agua Caliente Casino excluding AC Fuel.

3.     Slot Players must activate their electronic drawing entries on the day of each drawing. In order to successfully activate electronic drawing entries towards each drawing, the qualified ACE Club members will be required to follow the below steps:

a.       Using their ACE Club Card, the ACE Club member will begin a session of play at a slot machine. 

b.       The ACE Club member must close their rating by removing their ACE Club Card from a slot machine at least 10 minutes prior to any upcoming drawing time.  This process must be repeated for every drawing time to repopulate any new entries earned into the electronic drawing drum. 

4.     For slot players and table game players, all electronic drawing entries must be activated a minimum of (2) hours and at least ten (10) minutes prior to each drawing time in order to be eligible to win. A sweep will be done on PlayerSoft ten (10) minutes prior to the drawing time to begin populating entries earned up to that point for winners. Announcements will be made on the Casino Floor from each promotional area throughout the drawing day to remind patrons how and when to activate their electronic drawing entries

5.     Table Games players earn electronic drawing entries by accumulating a $5 table game theoretical win while playing at a table with their ACE Club Card. Table game players earn one (1) electronic drawing entry per $5 table game theoretical win accumulated during the promotional period.  Table game entries can be earned at Agua Caliente Casinos excluding Agua Caliente Fuel. (See “Table Game Electronic Drawing Entry Earning”)

6.     Table Games players must activate their electronic drawing entries on the day of the drawings. In order to successfully activate electronic drawing entries towards each drawing, the qualified ACE Club members will be required to follow the below steps. 

a.       Using their ACE Club Card, the ACE Club member must begin a session of play at a table game a maximum of two (2) hours before each drawing session.

b.       A Table Games Floor Supervisor (or above) must close all player ratings 30 minutes prior to the first drawing and every two hours until the end of the promotion to activate the electronic drawing.

c.       If a player is actively playing at the time of activation, a Table Games Floor Supervisor (or above) will close the rating to activate entries and then re-open their rating immediately.  This process must be repeated for each activation time, to repopulate any new entries earned into the electronic drawing drum since the last activation.

7.     Once an electronic drawing entry is selected and the winning name is announced, the player will have three (3) minutes to report to the drawing area. Winners may also contact a Slot or Security Department employee. The Slot or Security Department employee will notify an authorized Marketing representative that a winner has identified themselves within the three (3) minute time limit and is being sent to the drawing area to be verified as an eligible winner before another name is drawn. The winner’s drawing and eligibility will be verified by two (2) authorized Marketing representatives before the prize is awarded. A Winners Log will be kept to indicate the entries drawn, winner’s name(s) and any electronic drawing entries drawn that are “ineligible “or “no-shows”.

8.     All drawing promotions shall have a 30-minute verification period to determine winner eligibility after a winner has been chosen.

9.     Must be present to win. In the event that a winner does not show up, we will re-draw for another winner. This allows another ACE Club member an opportunity to win in that drawing. In the event the winner does not show up to claim their prize within the allotted three (3) minute period, that winner will be marked as a “no-show” on the Winners Log. 

10.  Winners must show valid identification to claim a prize (i.e. driver’s license, government-issued photo ID card, Agua Caliente Band of Cahuilla Indians Tribal ID, military ID or passport:  Federal Regulations prohibit the copying or scanning of military or military dependent identification cards). Winners must also show their ACE Club Card to claim a prize.

11.  Players are not permitted to designate a representative to play or collect rewards on their behalf. 

12.  For Non-Negotiable Chip Prizes, an authorized Marketing representative will verify each winner’s ID and ACE Club Card before prizes are issued. An authorized Marketing representative will require the winner to sign the Winners Log before issuing a Non-Negotiable Chip Prizes Comp Voucher to the ACE Club member’s account. Once the voucher has printed the, the authorized issuer (or above) will sign the voucher with name and gaming license number and instruct the winner to present the voucher to the Main Cashier’s Cage to receive their prize in Non-Negotiable Chips. Non-Negotiable Chip vouchers expire 24 hours after issuance.

13.  Winners agree that, as a condition of entry, a Winners Log and a Winner’s Release Form will be signed prior to the payment of prizes (if applicable). The Winner’s Release Form gives Agua Caliente Casinos and its agencies the rights to use the winner’s name, character, voice, likeness etc. in any future advertising, without any further compensation due to the winner. The release also holds Agua Caliente Casinos, the ACBCI, its employees, etc. harmless from the award or use of the prize.

14.  The Winners Release Form will include space for two (2) employee signatures: One (1) Marketing representative, and one (1) additional signature for verification, completed by a Marketing representative. Winners are responsible for all Federal, State and local taxes for all awards as a result of this promotion where applicable. Winners must provide a social security number and/or W-9 Form (if applicable) prior to receipt of their award or prize per the Reporting and Withholding Internal Controls.

15.  For each electronic drawing entry drawn, a Marketing representative will enter the following information on the Winners Log: date of the promotion; winner’s name and ACE Club number; and the award or prize won. The Marketing representative will sign with name and gaming license number on the last page of the log attesting to the prize distribution. The winner will sign the log, evidencing they have received the prize.

16.  In the event that all systems go OFFLINE and become inoperable for any reason, the on-site ACGC Gaming Inspector Department and ACGC Surveillance Department will be notified immediately. Drawings will cease until the system is back online and fully operational. No manual drawing entries or prizes will be issued in lieu of the system being “offline.” 

17.  For all valid weeks, electronic drawing entry earnings will accumulate throughout the entirety of the promotion and will expire on Friday, September 27, 2024, at the end of the last drawing.

GENERAL RULES

1.     Must be 21 years or older to participate.

2.     Must be an ACE Club member to participate.  

3.     Restricted players are not eligible for this promotion.

4.     Employees of Agua Caliente Casinos and Agua Caliente Band of Cahuilla Indians with an Agua Caliente Gaming Commission issued gaming license are not eligible to participate. 

5.     All drawing promotions shall have a 30-minute verification period to determine winner eligibility after a winner has been chosen.

6.     Winners must be present to order to claim a prize. 

7.     All grand prize-winning plays are subject to verification by Odds On Promotions, whose decisions are final and binding.

8.     Odds On Promotions reserves the right to decide the payout process of the $1,000,000 Cash Grand Prize. 

a.     Yearly installments made payable to the promotion. Winner equal to the Prize Value divided by the length of the annuity contracted for (i.e. $1,000,000 prize/ 40-year annuity = $25,000 per year installment for 40 years). Installments shall commence at the conclusion of the claim investigation and will be made the same date each year.

b.     Purchase a single premium deferred annuity from an A.M Best rated “B” or better Legal Reserve Life Insurance Company, with annual installments equal to the Prize Value divided by the length of the annuity contracted for. The selection of said company will be at the sole discretion of Hole in One International/Odds On Promotion

c.     Purchase any other investments grade funding vehicle or financial instrument, which shall be sufficient to meet the obligation described herein. The selection of said instruments will be at the sole discretion of Hole in One International/Odds On Promotions. 

9.     Should a contestant appear to win the Cash Grand Prize, the promotion will pause on the “Odds On” game kiosk until all necessary verification and reset procedures are executed. Subsequent to the performance of necessary verification and reset procedures, the promotion may continue using the Manual Game Experience (see General Rule #12) with no opportunity for another $1,000,000 Cash Grand Prize to be awarded. 

10.  Immediately upon a contestant reaching the top tier of the game kiosk indicating the Cash Grand Prize, the Special Events Team from that winning property will notify all other members of the Special Event Teams running the promotion at other properties, as well as the Special Events Director, on-site Gaming Inspector Agents, ACGC Surveillance and the Senior Director of Marketing via telephone, text and/or email.

11.  The minimum Cash Prize that could be won: $250 Cash (or $150 FSP/NNC). The maximum Cash Prize that could be won: $1,000,000 Cash Grand Prize. 

12.  Should another contestant appear to win another Grand Prize, a consolation prize will be issued as stated in the Prize Structure of $5,000 in Cash (or $3,000 FSP/NNC). The verified Cash Grand Prize of $1,000,000 in Cash may only be won one (1) time during the promotional period between all three (3) Agua Caliente Casinos.

13.  In the event that the $1,000,000 Grand Cash Prize is achieved and the “Odds On” game kiosk is temporarily locked in for verification, any subsequent winners for that property’s promotional day will play a ‘Manual Game Experience’ to determine their prize until the game Kiosk is unlocked.

14.  A contestant is not a winner of a $1,000,000 Cash Grand Prize, even if the visual display or prize receipt should so indicate, unless the odds established by the intended parameters of the promotion are beaten, as solely determined by the random number generator and memory logs of the promotion software, and the winning play did not occur as a result of any other scenario including but not limited to human error, software error, or machine malfunction.

15.  Current or former employees, family members, agents, successors, or assignees of Agua Caliente Casinos or any promotional agency involved with this promotion shall be ineligible to participate and/or claim any reimbursable prize within.

16.  Names and likenesses of promotion winner(s) may be used by Agua Caliente Casinos and Odds On Promotions for promotional purposes without further compensation.

17.  Winners agree that, as a condition of entry, a Winners Log and a Winners Release Form will be signed prior to the payment of prizes (if applicable). The Winners Release Form gives Agua Caliente Casinos and its agencies the rights to use the winner’s name, character, voice, likeness etc. in any future advertising, without any further compensation due to the winner. 19.  For each winner selected, a Marketing representative will enter the following information on the Winners Log: date and time of the promotion, winner’s name, winner’s ACE Club number and the award or prize won.  The authorized representative of the promotional event shall sign the log with their name and gaming license number attesting to the prize distribution. The winner will sign the log, evidencing they have received the prize.

20.  Winners must show valid identification to claim a prize (i.e. driver’s license, government-issued photo ID card, Agua Caliente Band of Cahuilla Indians Tribal ID, military ID or passport:  Federal Regulations prohibit the copying or scanning of military or military dependent identification cards). Winners must also show their ACE Club Card to claim a prize.

21.  Agua Caliente Casinos are not responsible for any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other errors within the offering or announcements of any award or prize notification, or for any errors of any kind, whether human, mechanical, clerical, electronic, or technical in nature, including but not limited to areas of the casino facility where speakers are not present or functioning or for the incorrect, inaccurate or failure to capture the appropriate information. Agua Caliente Casinos are not responsible for incomplete, illegible, misdirected, late, lost, damaged, stolen, postage due, direct marketing offers.

22.  The Agua Caliente Casinos reserve the right and sole discretion to disqualify any gaming participant who has been identified as having “tampered”, in any way deemed inappropriate, with the direct marketing offers. This includes but is not limited to, counterfeiting or copying of drawing entries, placing foreign objects or inappropriate markings on the entries or direct marketing offers. This disqualification will also include but is not limited to “tampering” with the entry process or any other promotional related item, or acting in a manner that may be in violation of the Official Rules or in a disruptive manner with the intent to disrupt or to undermine the legitimacy of the promotion or with the intent to annoy, abuse, threaten, or harass any other person(s).

23.  Ace, Edge, or Elite Cards are the property of Agua Caliente Casinos. Use of these cards constitutes acceptance of the Rules of the ACE Players Club and will also be advertised within the ACE Players Club Brochure. 

24.  Direct marketing offers are valid only on the date/time shown on the direct marketing offer and are non-transferable, non-refundable and have no cash value; no change given and may not be combined with any other discount or group rate. 

25.  Facsimiles or reproductions of direct marketing offers will not be accepted; any attempt to duplicate, alter, modify or change offer voids use.

26.  Agua Caliente Casinos are not responsible for equipment malfunctions, including, but not limited to computer systems or any gaming related equipment utilized to administer this promotion.

27.  All patron disputes related to this promotion will be handled in accordance with the ACBCI Guest Disputes Internal Controls.

28.  All promotions will be administered in accordance with the ACBCI systems of internal controls, policies, and procedures.

29.  Agua Caliente Casinos must include a responsible gambling message on printed materials for this promotion where practical. The message will read: Problem Gambling? Call 1-800-GAMBLER. Signage must also be located within each Casino.

30.  A copy of the promotion rules must be displayed or made readily available to patron upon request during the duration of the promotion. The rules may be available via rules poster, rules rack card/flyer, or on the Agua Caliente Casinos website. The Marketing Department will always have a copy of the rules during the promotion.

31.  All Cash Prize winners must be paid at the Main Cage. 

32.  All prizes may be taken in FSP or NNCs – in the amount of 60% of the Cash Prize, except the Grand Prize of $1,000,000, which must be taken in Cash.

33.  Non-Negotiable Chip Prizes will be paid out via a voucher issued to the winner that is then redeemed at the Main Cashier’s Cage. Non-Negotiable Chip vouchers expire 24 hours after issuance.

34.  If the Prize is requested in either Free Slot Play or NNC, it must be taken in either all Free Slot Play or all NNC (no partial payments).

35.  Free Slot Play prizes will expire from date of redemption based on the amounts below:

a.     $101 – $1,500 – Expires in 30 days

b.     $101 – $1,500 – Expires in 30 days

c.     $1,500 – $5,000 – Expires in 60 days

36.  The Agua Caliente Gaming Commission (hereinafter referred to as the ACGC) retains the right to suspend, rescind, or void any promotion that fails to maintain and protect the assets, integrity and reputation of the Tribe.
